DATA SAFEGUARD will strive to keep its services running reliably but DATA SAFEGUARD will not be held responsible for any losses you may incur through their use. If you are a business, you should ensure that you have adequate business insurance, and we recommend you contact an insurance agent or broker.
As a customer of DATA SAFEGUARD, you agree to indemnify, defend and hold harmless DATA SAFEGUARD, its officers, directors, employees, affiliates, or resellers from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) that may arise from your use of our services.
Unless specifically addressed and mutually agreed to within a service level agreement, DATA SAFEGUARD will not cover you for any losses due to hacker attacks, denial of service attacks or other criminal activities. If your business relies on your backup up data for commercial purposes, it is your responsibility to ensure that you have proper business insurance coverage.
As a customer of DATA SAFEGUARD, you agree that you are responsible for any content you provide (encryption strength) to your allocated backup location, and it is your sole responsibility to ensure that your systems have adequate security including firewall/s, antivirus, adware and spywhere detection. Also the data does not contain any virus, adware, spywhere, illegal information or infringe upon any existing trademark or copyrighted material.
DATA SAFEGUARD Privacy Policy:
Data Safeguard is committed to protecting your online privacy. The following policy explains how your personal information will be used when you register for a Data Safeguard account. If we are going to use customers' personally identifiable information in a manner different from that stated at the time of collection we will notify customers by posting a notice on our website for 30 days.
1. DISCLOSURES OF YOUR INFORMATION
Data Safeguard does not give, sell, rent, share, or trade any identifiable personal information regarding you to any third party, with the exception of third-party contractors or service providers, such as ad serving partners, photo printing partners and other fulfillment agencies who work with Data Safeguard to provide Data Safeguard, and who are contractually prohibited from other use of the information. Data Safeguard provides members with online storage space, which can be used to store, share, access and protect members' data and information. All information collected as a result of your subscription to Data Safeguard will be controlled by Data Safeguard.
3. ONLINE REGISTRATION FORM AND COLLECTION OF PERSONAL DATA
Data Safeguard collects personal information upon registration. During registration Data Safeguard will typically ask for your name and email address. When becoming a client Data Safeguard will ask for your credit card or payment information, billing and shipping information in order to provide you with uninterrupted service. Once a registered member account is created, you can take full advantage of Data Safeguard services.
In addition to registration we may ask you for personal information at other times, including immediately following the registration process, when you enter a contest or promotion sponsored by Data Safeguard, and when you report a problem with the service or with your account. If you contact Data Safeguard we will keep a record of the correspondence.
Data Safeguard members use the services to store data and information, such as files, folders, contacts, favorite sites, photos, calendar data, and other data. Data Safeguard will not review, share, distribute, print, or reference any such data except as outlined in the Terms of Service or as may be required by law.
4. IP ADDRESS
Data Safeguard may also record your IP address for system administration, monitoring, and fraud prevention purposes. IP addresses are not linked or cross-referenced with any personally identifiable information.
5. SECURITY OF ACCOUNT INFORMATION AND DATA
When you register for a Data Safeguard account or at a later time, the join page or an upgrade form may ask you for sensitive information, such as your credit card number. Information collected on such forms is encrypted and is protected with industry standard SSL encryption. While on a secure page, such as our join page, the padlock icon on the bottom of most Web browsers becomes locked. Your Data Safeguard account information and data are password protected so that you, and only you, have access to this personal information.
5a. SUPPORT SITE & DSG BACKUP SOFTWARE
We require that you do not tell, share, or give away your password to anyone. Data Safeguard will never ask you for your password, in an email or by phone. Also, remember to log out of your Data Safeguard account and close your browser window when you finish your work. This is suggested to ensure that others cannot access your personal information and data if you share a computer with someone else or are using a computer in a public place e.g. library or Internet cafe.
6. EXTERNAL LINKS
The Data Safeguard website may contain links to other companies and their websites. Data Safeguard is not responsible for and makes no representations about the privacy practices of such companies or the content of their websites.
8. CORRECTING OR UPDATING YOUR PERSONAL DATA
You can edit your Data Safeguard account information at any time by accessing your account, your profile information can be modified by clicking on the “My Profile” page, once you are logged in.
Your Data Safeguard account can be easily deleted or deactivated at any time. Doing so will result in losing access to your account data and information stored on your account.
